Privacy Policy

Introduction

This Privacy Policy explains how we manage personal information. It also describes your rights to access and correct personal information we hold about you, and how you can make a complaint about our management of your personal information. This is in addition to our obligations of confidentiality to clients and other parties arising from sources other than the Privacy Act.

Paxton-Hall Lawyers Pty Ltd (PHL) collects and uses information for the purposes of providing legal services.  This includes information about clients and business contacts.

PHL’s collection, storage, use and disclosure of personal information is governed by the Australian Privacy Principles contained in the Privacy Act 1988 (Cth) (Privacy Act).  You can access the Privacy Act here.

PHL has policies and procedures in place to ensure that the collection, storage, use and disclosure of personal information is done in a safe, secure and confidential manner to ensure your rights are protected.

You and your information

PHL will only collect and use information that is necessary to our business of providing legal services (our services), or as required by law.

PHL will take reasonable steps to ensure that the information which it holds is accurate, complete and up-to-date.

PHL will give an individual access to all personal information it stores about the individual in a timely manner, unless an exception applies under the Privacy Act.

Kinds of information collected

PHL collects personal information about clients, business contacts and job applicants and sometimes visitors to our website for the purposes of providing our services which may include marketing activities.

Personal information is defined in section 6 of the Privacy Act as “information or an opinion about an identified individual, or an individual who is reasonably identifiable whether the information or opinion is true or not and whether the information or opinion is recorded in a material form or not”.

PHL will collect and hold details of individuals which include:

  1. Identity information:
    1. full name;
    2. address;
    3. contact number;
    4. email address; and
    5. date of birth.
  2. matter-related information being information relevant to your legal matter;
  3. communication records; and
  4. where relevant to your matter, sensitive information including racial and ethnic origin, political beliefs, religious affiliation and health information.

Collection and storage of personal information

  1. PHL will collect personal information directly from you when you:
    1. engage us to provide legal services;
    2. engage us to provide legal services;
    3. respond to communication with us or engage a solicitor or agent to do so;
    4. contact us by telephone, email, post or in person; or
    5. complete forms (including via our website) or provide documents to us;
  2. We may also collect personal information about you from third parties where necessary including:
    1. our client(s), where we collect information in the course of providing legal services;
    2. other parties to legal proceedings or transactions and their lawyers;
    3. professional advisors e.g. accountants;
    4. witnesses of fact, expert witnesses, health care providers and hospitals;
    5. courts, tribunals, law enforcement and government agencies;
    6. publicly available sources, including public registers, websites and social media.
  3. PHL will store the personal information in the following manner:
    1. All relevant personal information will be entered into and held on PHL’s electronic database maintained on PHL’s secure cloud-based server. The database is password protected and only accessible by authorised PHL staff. The server is maintained in Brisbane.
    2. Personal information contained in written forms and hard copy documents will be kept in safe and secure storage.

Purpose of collection, holding, use and disclosure of personal information

  1. PHL will only collect personal information when it is reasonably necessary for one of PHL’s functions or activities related to the provision of our services such as providing legal services to our clients, complying with regulatory and insurance obligations and operating our practice.
  2. PHL will not use or disclose personal information for any other purpose unless:
    1. consent has been given by the individual; or
    2. the individual would reasonably expect PHL to disclose the information for another purpose which is directly related/related to PHL’s primary purpose of providing our services; or
    3. PHL is required or authorised by law and/or under the Privacy Act.

Access to and correction of personal information

You have a right to request access to your personal information that PHL holds about you.  There is no fee involved in making such a request.

If any of the personal information that PHL holds is incorrect, incomplete or out of date, please let us know by contacting our Privacy Officer and it will be corrected accordingly.

Complaint policy

If you have a complaint about a breach of the Australian Privacy Principles by PHL in relation to your personal information, please contact our privacy officer.

The first step is to lodge your complaint in writing to PHL. PHL takes any complaint regarding the privacy of personal information seriously and will work with you to try to resolve the complaint.  PHL will consider and respond to a written complaint within a reasonable time (usually 30 days).
